General Terms and Conditions (GTC)

for Hosting and Cloud Services

These General Terms and Conditions (GTC) apply to all contracts between PixoVista (hereinafter referred to as the “Provider”) and its customers regarding the use of hosting and cloud services based on the open-source software Immich.

Deviating terms and conditions of the customer shall not apply unless expressly agreed to in writing.

1. Scope of Services

PixoVista provides hosting services for private photo and video collections. The Provider supplies server resources, storage capacity, and operates the Immich software.

The specific scope of services is determined by the booked package (SINGLE or ADMIN).

2. SINGLE and ADMIN Packages

SINGLE packages consist of a single user account without user management or partner/family sharing.

ADMIN packages include a dedicated Immich instance with administrative privileges. The customer may create and manage users and enable sharing features.

The customer is responsible for user management within ADMIN packages.

3. Free SINGLE Package

PixoVista offers a permanently free SINGLE package with 5 GB of storage. This is not a time-limited trial.

The Provider reserves the right to restrict or discontinue the free offer in cases of misuse or violation of these GTC.

4. Contract Term and Termination

Paid packages are billed monthly or annually. The contract may be terminated by the customer at any time effective at the end of the current billing period.

Termination is possible even on the last day of the term. There is no automatic renewal unless a new booking is made.

5. Prices and Payment Terms

The prices valid at the time of ordering apply. All prices include statutory taxes unless stated otherwise.

The Provider may adjust prices for future billing periods. Already paid periods remain unaffected.

6. Availability and Maintenance

PixoVista strives to ensure high service availability. Continuous, uninterrupted availability cannot be guaranteed.

Maintenance, security updates, or technical measures may result in temporary service interruptions.

7. Data Backups

Regular backups are performed to enable recovery in case of technical issues.

Complete or uninterrupted data backups cannot be guaranteed. Customers remain responsible for backing up critical data.

8. Customer Obligations

Customers must not misuse the services or store or distribute unlawful content.

Content violating applicable law, third-party rights, or these GTC is prohibited.

9. Liability

The Provider is liable only for damages caused by intent or gross negligence.

Liability for data loss, loss of profit, or consequential damages is excluded to the extent permitted by law.

10. Data Protection

Personal data is processed in accordance with PixoVista’s Privacy Policy and applicable data protection regulations.

PixoVista acts as a data processor pursuant to Art. 28 GDPR.

11. Amendments

PixoVista reserves the right to amend these GTC. Customers will be informed in due time.

If no objection is raised within a reasonable period, the amended terms shall be deemed accepted.

12. Final Provisions

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Place of jurisdiction is the Provider’s registered office, insofar as legally permissible.

Should any provision of these GTC be invalid, the remaining provisions shall remain effective.
